Welcome to TargetHit. These Terms of Service ("Terms") govern your use of the TargetHit website, platform, and services (collectively, the "Service") operated by TargetHit ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Service Description

TargetHit provides the following services:

  • Trading Signals: Real-time cryptocurrency trading signals generated through algorithmic analysis and AI-powered systems
  • Auto-Trade Feature: Automated trade execution through integration with supported cryptocurrency exchanges via API
  • Performance Tracking: Historical signal performance data and analytics
  • Educational Content: Trading guides, tutorials, and market analysis materials

2. User Eligibility

To use our Service, you must:

  • Be at least 18 years of age or the legal age in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Not be located in, under the control of, or a national or resident of any country where cryptocurrency trading or our services are prohibited or restricted
  • Not be on any sanctions list or restricted persons list
  • Comply with all applicable local, state, national, and international laws and regulations

3. Account Responsibilities

3.1 Account Creation

When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

3.3 One Account Per User

Each user may only maintain one account. Creating multiple accounts may result in termination of all associated accounts.

4. Subscription Terms

4.1 VIP Subscription

TargetHit offers VIP subscription plans that provide access to premium features, including advanced signals, auto-trade functionality, and priority support. Subscription details, pricing, and features are displayed on our pricing page.

4.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • You authorize us to charge your payment method on file for all subscription fees
  • Prices are subject to change with 30 days' notice for existing subscribers

4.3 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds are provided for unused portions of a billing period unless otherwise specified in our Refund Policy

4.4 Free Tier

We may offer a free tier with limited features. Free tier users are subject to these Terms and any additional limitations specified for free accounts.

5. Auto-Trade Feature

5.1 Description

The Auto-Trade feature allows you to connect your cryptocurrency exchange account via API to automatically execute trades based on our signals.

5.2 User Responsibility

By using the Auto-Trade feature, you acknowledge and agree that:

  • You are solely responsible for all trading activity executed through Auto-Trade
  • You understand and accept the risks associated with automated trading, including potential losses
  • You have read and understood our Risk Disclosure before enabling Auto-Trade
  • You will only allocate funds that you can afford to lose entirely

5.3 No Guarantees

We do not guarantee that Auto-Trade will execute trades successfully, profitably, or in a timely manner. Factors outside our control, including exchange downtime, API limitations, network latency, slippage, and market conditions, may affect trade execution.

6. API Key Handling

6.1 Security

Exchange API keys you provide are encrypted using industry-standard encryption methods and stored securely. We implement security best practices to protect your API credentials.

6.2 Permissions

You should only grant the minimum necessary permissions to your API keys. We recommend enabling only trading permissions and disabling withdrawal permissions for API keys used with TargetHit.

6.3 User Responsibility

You are responsible for creating, managing, and securing your API keys on your exchange account. You agree not to share API keys that have been connected to TargetHit with any third party.

7. Intellectual Property

7.1 Our Content

The Service, including its original content, features, functionality, trading algorithms, signal methodology, and branding, is owned by TargetHit and is protected by copyright, trademark, and other intellectual property laws.

7.2 Restrictions

You may not:

  • Copy, modify, distribute, sell, or lease any part of our Service
  • Reverse engineer or attempt to extract the source code of our algorithms
  • Redistribute, resell, or commercially exploit our trading signals
  • Use automated systems to scrape or collect data from our Service

8. Limitation of Liability

8.1 Trading Signals

Trading signals provided by TargetHit are not guarantees of profit. Cryptocurrency markets are volatile and unpredictable. Past performance of signals does not guarantee future results.

8.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.3 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARGETHIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

8.4 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless TargetHit and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

10. Termination

10.1 By You

You may terminate your account at any time by contacting support or using the account deletion feature in your settings.

10.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You breach these Terms
  • You engage in fraudulent or illegal activity
  • You abuse the Service or other users
  • Required by law or regulatory authority
  • We discontinue the Service

10.3 Effect of Termination

Upon termination, your right to access the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, and indemnification.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, Risk Disclosure, and any other legal notices published on the Service, constitute the entire agreement between you and TargetHit.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
